Terms of Use and Disclaimer

1. Acceptance

By using the Site you agree to these terms and to the Privacy and Cookie Policy. If you do not agree, please do not use the Site.

2. What this Site is

This Site is a portfolio and marketing site for the web design, web development, automation and related services of Himanshu Khandelwal ("I", "me"). It is for general information only. Nothing on it is a binding offer. I only agree to do work, and you only agree to buy it, when we both accept a written proposal or agreement that sets out the scope, price, timeline and payment terms.

3. No guarantee of results

• I do not guarantee, warrant or promise any particular result, including any increase in sales, revenue, enquiries, leads, traffic, search-engine rankings, social reach, conversion rates or return on investment.
• A website is one part of a business. Results depend on factors outside my control, such as your product or service, pricing, market, competitors, advertising, content, seasonality, customer service, how you use the website, and changes made by search engines, social platforms and other third parties.
• Statements such as "turn visitors into customers", "bring in clients" or "win more customers" describe the purpose of my design approach. They are not promises of an outcome.
• Past projects, examples and reviews do not guarantee similar results for you.
• Search engine optimisation is described as a feature of how a site is built. I do not guarantee any ranking, position or traffic.

4. Reviews and testimonials

Reviews, ratings and quotes on the Site reflect the personal opinions and experiences of the individuals named. They are not typical, guaranteed or a prediction of your results. Star ratings are each reviewer's own assessment and the average shown is calculated from those ratings only. Individual experiences and results vary.

5. Free consultation

A free call or chat is an introduction. It creates no client relationship, no duty of confidentiality and no obligation for either of us until we sign a written agreement. Please do not share confidential or sensitive information before then. Anything I say in a consultation is general guidance, not a guarantee.

6. Paid work

Paid work is governed by a separate written agreement or accepted proposal. Unless that agreement says otherwise: timelines are good-faith estimates and depend on you supplying content, feedback and approvals on time; the number of design revisions is limited to what the agreement states; and ownership of final deliverables passes to you only when you have paid in full.

7. Cyber security information

• References to cyber security, capture-the-flag (CTF) competitions and related skills are for general information about my background. They are not legal, technical or professional advice.
• I carry out security testing only on systems where the owner has given me explicit written authorisation. Do not ask me to access any system, account or data without permission, and do not use anything on this Site to do so. Unauthorised access is a crime in most countries, including under the Information Technology Act, 2000 (India).
• No security measure can make a system completely secure, and I cannot guarantee that any website, tool or system will be free of vulnerabilities or immune to attack.

8. Intellectual property

The design, text, code, graphics, photographs and video on this Site are owned by or licensed to Himanshu Khandelwal and are protected by copyright. You may view the Site and share links to it. You may not copy, reproduce, modify, redistribute or use its content, design or code for another site or product without my written permission. Names, logos and screenshots of client websites and products belong to their respective owners and are shown only to illustrate my work.

9. Third-party websites

The Site links to and shows previews of websites I do not control, including websites I built for clients (for example BrandCrafters, Embassy of Education and Haviella Homes) and platforms such as GitHub, LinkedIn, Instagram and WhatsApp. Those websites are run independently. I am not responsible for their content, availability or privacy practices, and a link is not an endorsement of anything on them. Projects marked "Building" are in development and may change or never be released.

10. Acceptable use

You agree not to misuse the Site: for example, by trying to gain unauthorised access to it or its hosting, introducing malicious code, overloading it with automated requests, scraping it at scale, or using it unlawfully.

11. Site provided "as is"

I try to keep the Site accurate and available, but it is provided "as is" and "as available". I make no warranty that it will be uninterrupted, error-free or free of harmful components, or that the information on it is complete or up to date.

12. Limitation of liability

To the fullest extent permitted by law, I am not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, data or goodwill, arising from your use of, or inability to use, the Site or from relying on anything on it. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including for fraud. Liability for paid work is governed by the written agreement for that work.

13. Privacy and cookies

How I handle personal data, including Google Analytics and your cookie choices, is explained in the Privacy and Cookie Policy. You can change your choice any time through Cookie settings.

14. Governing law and disputes

These terms are governed by the laws of India. If a dispute arises, please contact me first so we can try to resolve it informally. If it cannot be resolved that way, the courts in Rajasthan, India have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings elsewhere.

15. Changes and general

I may update these terms by posting a new version here with a new "Last updated" date. If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with the Privacy and Cookie Policy and any written agreement between us, are the whole agreement about your use of the Site.
